Enforcement of arbitral awards concerning real property and the right of defense of third-party possessors who were not parties to the arbitration proceedings

Abstract
Under Peruvian law, the enforcement of arbitral awards against third-party possessors who are not parties to the arbitration agreement creates tensions between the effectiveness of the award and the guarantees of due process and effective procedural protection. The objective was to determine how the enforcement of arbitral awards concerning real property affects the right of defense of third-party possessors who have not been parties to the arbitral proceedings. The population consisted of 55 attorneys specialized in Civil Law, Civil Procedural Law, and Arbitration Law, with the entire population considered as the sample through a basic census sampling method. The study was conducted at an explanatory level, using a synthetic-analytical method and a non-experimental, cross-sectional explanatory design. Data were collected through a survey technique, using a questionnaire as the research instrument. The results showed that 94.5% of the surveyed attorneys considered that the rights of third-party possessors over the real property were affected, while 90.9% identified an impact on due process and 89.1% on the right of defense. Likewise, 90.9% supported the inclusion of the affected third party in the judicial enforcement of the arbitral award. It is concluded that the enforcement of arbitral awards concerning real property affects the right of defense of third-party possessors who have not been parties to the arbitral proceedings. Therefore, it is necessary to adjust the arbitration regulations in order to guarantee adequate defense for third parties with legal standing
